Talking Louis LLC (“Talking Louis,” “we”, “us”, or “our”) recognizes the importance of protecting the privacy needs of users of TalkingLouis.com, CarpeJuvenis.com, and all other websites, online services, and other interactive features or downloads, whether accessed via a computer, mobile device, or otherwise (individually, the “Site”, and collectively, “Sites”), customers of our products, subscribers to our mailing lists, and participants in our surveys and contests (collectively, “Users”).

This policy describes the Personal Information (e.g. name, address, email address, phone number, etc.) Talking Louis LLC and its subsidiaries and affiliated companies gather about you, what we do with it, the safeguards we have in place to protect it, and how you can control our use of such Personal Information. You will have an opportunity to unsubscribe in the footer of the email communication that we send you. By providing your personal details to us, you signify your acceptance of our Privacy Statement as set out below. If you do not agree to this statement, please do not provide your personal details to us.

This Privacy Policy applies to the Site and all other websites, online services, and other interactive features or downloads from the Sites that we own and control. The Sites are owned by Talking Louis LLC or one of its subsidiary or affiliated companies (collectively, “TL” or "Talking Louis LLC"). This Privacy Policy only covers information collected at the Sites. This Privacy Policy may apply to information TL collects offline, but only if specifically stated at the time of collection or if the information is combined in our databases.

This Privacy Policy and does not apply to third party websites, products, services or applications (collectively, “Third Party Sites or Services”) to which we may provide links. The collection and use of your information by Third Party Sites and Services is governed by the applicable third-party privacy policies.  For example, if you link to, enter, download, or provide information to or through any Third Party Sites or Services, such as by visiting third party websites that are linked to the Site, purchasing products from third party websites, or entering contests offered by third parties, the use and collection of your information by the applicable third party will not be governed by this Privacy Policy but rather by the privacy policy published by that third party.

We may change this Policy from time to time. If we make changes, we will notify you by posting the revised Policy to our Site. We encourage you to review this Policy whenever you access the Sites to stay informed about our information practices and the ways you can help protect your privacy.

California Residents – Your CA Privacy Rights

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request from companies conducting business in California certain information relating to third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes. Alternatively, the law provides that a company may comply, as TL does, by disclosing in its Privacy Policy that it provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice. As stated below in this Privacy Policy, TL provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you do not opt-in or if you opt-out at the time TL offers that choice, TL does not share your information with that identified third party for its direct marketing purposes.

No Information Collected from Children

The content and services provided by us or our affiliates, sponsors and advertisers, including without limitation the Sites, are not intended for anyone under the age of 18 and you should not access such content or services if you are under the age of 18. No information is knowingly collected or retained from children under the age of 13, nor is any such information knowingly used for any marketing or promotional purposes whatsoever, either inside or outside the Site. No part of the Site is designed to attract anyone under the age of 13. Children are not eligible to use any services provided by us and we ask that children under the age of 13 not submit any personal information to us or visit the Site.

Information Collection and Use Practices

We collect two kinds of information related to you: (a) Personally Identifiable Information (“PII”); and (b) Non-Personally Identifiable Information (“Non-PII”).

Personally Identifiable Information (“PII”) 

PII includes any information that identifies or could be used to uniquely identify, contact or locate you. We may collect personally identifiable information (“PII”) such as your name, your contact information, your shipping information, and your billing information (such as credit card account data). In operating Talking Louis LLC, we may include registration, online surveys, and other online forms that ask you to provide your names, e-mail addresses, age group, and other contact information. We collect information that you provide directly to us. For example, we may collect information when you place an order, send submissions, communicate with us via third party social media sites, use the interactive areas and features of our Site, request support, or otherwise communicate with us. You may also provide contact information when placing an order on the Site, certain demographic information about you (e.g., age, gender, preferences, etc.) when participating in a survey or poll, or general comment and/or recommendation when posting on the Site. You may choose to provide us with access to certain personal information stored by third parties such as social media websites (e.g., Facebook, Instagram, and Twitter). The information we may receive varies by website and is controlled by that website. By associating an account managed by a third party with the Site, you authorize us to have access to this information and you agree that we may collect, store and use this information in accordance with this Privacy Policy.

We use the PII that we collect to provide services (such as to process and ship your orders or respond to customer service requests), to analyze and improve our online platforms, and to conduct marketing. If you register for email, or if you provide your email address to us, we will send you emails about a variety of topics such as product launches, classes and events, special sales, promotional offers, and/or related topics. Please see below for your choices regarding how we collect, use, and share your PII.

We share email activity data with our marketing email provider to help them better target email deployments to consumers. While our marketing email provider has access to email address and email activity and may share bulk/non-specific activity data, email addresses or specific email actions are not shared with other third parties. Should a consumer wish to opt out of this sharing, that consumer simply needs to opt out of marketing email from us.

Non-Personal Information and Automatic Collection

Non-PII is any information that does not uniquely identify you as a person, including PII which has been rendered anonymous. We may obtain non-PII either separately or together with your PII as described above. We automatically collect certain non-personal information when you use the Site. For example, we collect information about the devices you use to connect to the Site (such as the domain name, IP address of your computer or numeric identifier of your mobile device) and about how you use the Site (such as what time you visit). We, and our advertisers and ad servers, may also collect non-personal information outside the Site to measure the success of our advertising campaigns. We use the non-personal information that we collect for a variety of purposes such as to provide and improve the Site, and to analyze our advertising.

Our Site also uses third-party analytics vendors such as Google Analytics. The Site may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services Talking Louis LLC offers. Information about access times, pages viewed, browser type, language, and the website you visited before navigating to our Site may also be logged. We may also infer your geographic location based on your IP address. We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers and mobile network information.

Information You Post

All information that you share about yourself, whether PII or not, in a public open forum – such as on a social network – will be considered public information for the purposes of this policy. If you don’t want it to be public, please don’t post it.

Sharing of Information 

As stated above, we may collect and provide aggregate Non-PII information about our visitors to our advertisers, sponsors, promotional partners, and affiliates, such as how many persons visited a particular page or activity, the average age of our visitors on the site or page, or the likes and dislikes of our visitors, but this information does not include personal information about any individual visitor.

Use of Information Collected


Talking Louis LLC does not share personally identifiable information with third parties without your consent, with the following exceptions: (1)    Business Transactions: We may disclose PII and Non-PII held by us: (a) to a prospective seller or actual seller of any business or assets we acquire; (b) if all or any of our assets are acquired by a third party, in which case, PII and Non-PII may be one of the transferred assets. (2) Required Disclosures:  We may disclose and use any PII or non-PII if we are required to do so by law, with respect to copyright and other intellectual property infringement claims, or if we believe that such action is necessary to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, the Site, or other users; or (d) in an emergency to protect the health and safety of the Site’s users or the general public.

Please protect your data. No data transmission over the Internet can be guaranteed to be 100% secure. Therefore, Talking Louis LLC can’t warrant or guarantee that your information will be absolutely secure. Any transmission of data is at your own risk.

Talking Louis may collect and provide aggregate (Non-PII) information about our visitors to our advertisers, sponsors, promotional partners and affiliates, such as how many persons visited a particular page or activity, the average age of our visitors on the site or page, or the likes and dislikes of our visitors. We use log files, like most websites. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. This information isn’t linked to personally identifiable information and does not include any personal information about any individual visitor.

We may use information about you for various purposes, including to:

a.)    Operate and improve the Site

b.)    Provide the information you request and send you related information

c.)    Send you technical notices, updates, security alerts, and support and administrative messages

d.)   Respond to your comments and questions and provide customer support

e.)    Monitor and analyze trends, usage and activities in connection with the Site

f.)     Personalize and improve the Site and provide advertisements, content or features that match your profile and interests

g.)    Process and deliver contest and giveaway entries and awards

Cookies

Talking Louis LLC may use the standard “cookies”, “web beacons”, and other similar technologies to collect information in connection with the Talking Louis LLC services and our advertisements. A “cookie” is a computer file that acts as an identification card for your computer to distinguish your browser from others and enable us to serve you better. “Cookies” are a feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Site. We may work with third-party advertising companies that collect and use information about your online activities across sites over time, in order to deliver more relevant advertising when you are using the Site and elsewhere on the Internet. We do not operate or control this site and are not responsible for the opt-out choices available there. Social Sharing Features

The Site may offer social sharing features and other integrated tools (such as the Facebook “Like” button), which let you share actions you take on our Site with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. What if Talking Louis LLC is sold or discontinued?

In the event of a change in control resulting from, for example, a sale to, or merger with, another entity, or in the event of a sale of assets or a bankruptcy, Talking Louis LLC reserves the right to transfer your personal information to the new party in control or the party acquiring assets. We will only do that if the party we transfer the information to agrees that they will abide by our Privacy Policy for as long as they hold the information, and that they will not transfer the information to any other party who will not abide by our Privacy Policy.

Employment: EEOC

If you apply for an internship or job with Talking Louis LLC, the information you submit may also be shared with our parent and affiliated companies who may have similar positions available. In connection with your online application, we may ask you to provide us with self-identifying information (such as veteran status, gender and ethnicity) in connection with laws and regulations enforced by the Equal Employment Opportunity Commission ("EEOC"), the Office of Federal Contract Compliance Programs ("OFCCP") and similar state and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide us with such information, we may submit that information to the EEOC, the OFCCP and similar state and local regulatory agencies for business-related purposes, including, but not limited to responding to information requests, fulfilling regulatory reporting requirements and defending against employment related complaints.

Contents, Surveys, Giveaways, and Promotions

We may offer contests, surveys, giveaways, and other promotions that may require registration. By participating in a promotion, you are agreeing to the terms, conditions, or official rules that govern that promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing any sponsor(s) of the promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials. If you choose to enter a promotion, Personal Information may be disclosed to third parties (including, without limitation, a co-sponsor) or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the promotion’s official rules, such as on a winners list.
